Laws of an old sukkah

דין סוכה ישנה

636:1


An old sukkah — that is, one that was made more than thirty days before the holiday — is valid provided something new was done to it for the sake of the festival. For this, even a handbreadth by a handbreadth [of schach] is sufficient if it is in one place. If the new thing goes across the whole sukkah, even a little bit is sufficient. And if it was made for the sake of the festival, even if it was done at the beginning of the year, it is valid without anything new.

סעיף א

סוכה ישנה דהיינו שעשאה קודם שיכנסו ל' יום שלפני החג כשרה ובלבד שיחדש בה דבר עתה בגופה לשם החג ואפילו בטפח על טפח סגי אם הוא במקום אחד ואם החידוש על פני כולה סגי אפי' כל דהו ואם עשאה לשם החג אפי' מתחלת השנה כשרה בלא חדוש:

With respect to a potter who has two sukkot, one in front of the other, who fashions his pots in the inner one and sells them in the outer, the inner one does not fulfill his obligation. Because it serves as his dwelling throughout the year, it would not be evident [during the festival] that he is now dwelling there for the sake of the mitzvah. He may, however, fulfill his obligation using the outer one, for he does not dwell in it throughout the year.

סעיף ב

יוצר כלי חרש שיש לו ב' סוכות זו לפנים מזו ועשה קדירותיו בפנימית ומוכרם בחיצונה הפנימית אינו יוצא בה ידי סוכה כיון שהיא דירתו כל השנה אינו ניכר שדר בה לשם מצוה והחיצונה יוצא בה שהרי אינו דר בה כל השנה:
