U.S. Superior Court of the Arkansas Territory
Hempst. 72
Peter C. Parker, plaintiff v. Eli J. Lewis and Peter Edwards, defendants.
- Courts have a legal right to grant new trials in actions for torts, on the ground of excessive damages, and may grant any number until the ends of justice are answered.
- If a party, having leave to amend pleadings, files bad pleas, they may be stricken out on motion.
- A plea which amounts to the general issue, or does not answer the whole charge or count, is bad.
October, 1829.—Trespass before Benjamin Johnson, Thomas P. Eskridge, James Woodson Bates, and William Trimble, judges.
